1. Postanowienia ogólne1. General provisions

1.1. Usługodawcą i operatorem serwisu certain.cv oraz aplikacji create.certain.cv (dalej łącznie: Serwis) jest AVATARLAND Sp. z o.o. z siedzibą w Poznaniu, 60-325, ul. Trybunalska 46, NIP: 7792167451 (dalej: Operator lub „my"). Serwis działa pod marką AVATARLAND.EU. 1.1. The provider and operator of the certain.cv website and the create.certain.cv application (together: the Service) is AVATARLAND Sp. z o.o., registered at Trybunalska 46, 60-325 Poznan, Poland, tax ID (NIP): PL7792167451 (the Operator or "we"). The Service operates under the AVATARLAND.EU brand.

1.3. Niniejszy regulamin (dalej: Regulamin) określa zasady korzystania z Serwisu. Rozpoczęcie korzystania z Serwisu — w tym wysłanie zgłoszenia do bety — oznacza akceptację Regulaminu. 1.3. These terms (the Terms) set out the rules for using the Service. Using the Service — including submitting a beta application — constitutes acceptance of these Terms.

1.4. Użytkownik to osoba fizyczna korzystająca z Serwisu. Do korzystania potrzebne są: urządzenie z dostępem do internetu, aktualna przeglądarka i czynny adres e-mail; do rozmowy głosowej dodatkowo mikrofon i zgoda przeglądarki na jego użycie. 1.4. User means the individual using the Service. To use it you need: a device with internet access, an up-to-date browser and a working email address; for voice conversations you also need a microphone and browser permission to use it.

2. Czym jest usługa2. What the service is

2.1. Serwis to narzędzie do przygotowywania dokumentów aplikacyjnych. Użytkownik wskazuje ogłoszenie o pracę i wgrywa swoje CV lub profil zawodowy, a agent AI przeprowadza z nim wywiad kompetencyjny — tekstowy albo głosowy — i buduje prywatną bazę wiedzy o jego karierze. Na tej podstawie modele AI generują CV dopasowane do wskazanego ogłoszenia. 2.1. The Service is a tool for preparing job application documents. The User points to a job advertisement and uploads their CV or professional profile; an AI agent then conducts a competency interview — by text or by voice — and builds a private knowledge base about their career. On that basis, AI models generate a CV tailored to the indicated job advertisement.

2.2. Serwis udostępnia też dziennik aplikacji, w którym Użytkownik może samodzielnie notować przebieg swoich rekrutacji (daty wysłania CV, rozmów, wyniki). 2.2. The Service also provides an application journal in which the User can record the course of their own recruitment processes (dates of sending CVs, interviews, outcomes).

2.3. Przed wygenerowaniem dokumentu wybierasz jego ustawienia: język i rynek docelowy (m.in. Polska, Wielka Brytania, Irlandia, USA, Kanada, Australia, Nowa Zelandia), układ i nazwy sekcji, sekcje własne z własną treścią, opcjonalne zdjęcie oraz opcjonalną klauzulę zgody. Ustawienia możesz zapisać jako profil i wykorzystać przy kolejnych CV. 2.3. Before the document is generated you choose its settings: the language and target market (including Poland, the UK, Ireland, the USA, Canada, Australia and New Zealand), the layout and names of sections, custom sections with your own content, an optional photo and an optional consent clause. You can save these settings as a profile and reuse them for later CVs.

2.4. Zasadą działania Serwisu jest budowanie CV wyłącznie z informacji pochodzących od Użytkownika. Serwis nie dopisuje osiągnięć ani kwalifikacji, których Użytkownik nie podał lub nie potwierdził, a braki względem wymagań ogłoszenia pokazuje wprost w raporcie pokrycia. 2.4. The Service is designed to build the CV solely from information provided by the User. It does not add achievements or qualifications the User has not provided or confirmed, and it openly reports gaps against the job ad's requirements in a coverage report.

2.5. Serwis nie jest doradztwem zawodowym, kadrowym ani prawnym i nie gwarantuje żadnego rezultatu rekrutacyjnego — w szczególności zaproszenia na rozmowę ani zatrudnienia. 2.5. The Service does not constitute career, HR or legal advice and guarantees no recruitment outcome — in particular no interview invitation and no employment.

3. Status bety i dostęp3. Beta status and access

3.1. Serwis działa w zamkniętej wersji beta. Dostęp jest przyznawany indywidualnie: Użytkownik zostawia zgłoszenie („Poproś o dostęp"), a Operator zatwierdza je ręcznie. Operator nie gwarantuje przyznania dostępu, nie deklaruje terminu rozpatrzenia zgłoszenia i może odmówić bez podania przyczyny. 3.1. The Service operates as a private beta. Access is granted individually: the User submits an application ("Request access") and the Operator approves it manually. The Operator does not guarantee that access will be granted, gives no timeframe for reviewing applications and may refuse without stating a reason.

3.2. Korzystanie z Serwisu w okresie bety jest bezpłatne. Koszty modeli AI ponosi Operator. W zamian oczekujemy gotowości do przekazania szczerej opinii o działaniu Serwisu — nie jest to jednak warunek korzystania ani zobowiązanie umowne. 3.2. Use of the Service during the beta is free of charge. The Operator bears the AI model costs. In return we hope for honest feedback on how the Service works — this is not, however, a condition of use or a contractual obligation.

3.3. Każdy tester otrzymuje limit zużycia (pakiet obejmujący m.in. rozmowy z modelami AI oraz minuty rozmów głosowych), widoczny w aplikacji. Operator może ustalać, zmieniać i wyczerpane limity zwiększać na wniosek. Po wyczerpaniu limitu część funkcji może być czasowo niedostępna. 3.3. Each tester receives a usage allowance (covering, among others, AI model conversations and voice minutes), visible in the application. The Operator may set and change allowances and may increase an exhausted allowance on request. Once the allowance is used up, some features may be temporarily unavailable.

3.4. Wersja beta oznacza oprogramowanie w rozwoju. Operator nie udziela gwarancji dostępności ani nie zapewnia SLA, może wprowadzać zmiany, dodawać i wycofywać funkcje, przerywać działanie Serwisu na potrzeby prac technicznych oraz zakończyć betę. W Serwisie mogą wystąpić błędy i przerwy w działaniu. 3.4. Beta means software under development. The Operator gives no availability guarantee and provides no SLA, may make changes, add and withdraw features, suspend the Service for maintenance and end the beta. The Service may contain errors and experience downtime.

3.5. Po zakończeniu bety zasady korzystania — w tym ewentualna odpłatność — mogą ulec zmianie. Operator poinformuje o tym z wyprzedzeniem, na adres e-mail przypisany do konta lub komunikatem w aplikacji. Dalsze korzystanie z Serwisu po wejściu nowych zasad wymaga ich akceptacji; brak akceptacji oznacza możliwość rezygnacji zgodnie z pkt 13. 3.5. After the beta ends, the terms of use — including possible fees — may change. The Operator will give advance notice by email to the address linked to the account or via an in-app notice. Continued use after the new terms take effect requires accepting them; if you do not accept them, you may terminate as described in section 13.

4. Konto i wymagania4. Account and requirements

4.1. Konto jest osobiste — zakłada je i korzysta z niego jedna osoba fizyczna, we własnym imieniu i na własne potrzeby. Nie wolno udostępniać konta ani linku logowania osobom trzecim. 4.1. The account is personal — it is created and used by one individual, in their own name and for their own purposes. You may not share your account or login link with third parties.

4.2. Z Serwisu mogą korzystać osoby, które ukończyły 16 lat. Osoby, które nie ukończyły 18 lat, powinny korzystać z Serwisu za wiedzą opiekuna prawnego. 4.2. The Service may be used by persons who are at least 16 years old. Users under 18 should use the Service with the knowledge of their legal guardian.

4.3. Logowanie odbywa się bez hasła — jednorazowym linkiem wysyłanym na adres e-mail Użytkownika. Użytkownik powinien chronić dostęp do swojej skrzynki e-mail; każdy, kto ma do niej dostęp, może zalogować się na konto. O podejrzeniu nieuprawnionego dostępu prosimy niezwłocznie powiadomić Operatora. 4.3. Login is passwordless — via a one-time link sent to the User's email address. The User should protect access to their mailbox; anyone with access to it can log in to the account. Please notify the Operator promptly if you suspect unauthorised access.

4.4. Użytkownik podaje prawdziwy adres e-mail i dba o aktualność danych kontaktowych. 4.4. The User provides a valid email address and keeps their contact details up to date.

5. Rozmowa z AI5. Talking to AI

5.1. Rozmówcą Użytkownika jest system sztucznej inteligencji, a nie człowiek — dotyczy to zarówno wywiadu tekstowego, jak i rozmowy głosowej. Agent głosowy przedstawia się jako rekruter AI i na pytanie Użytkownika potwierdza, że jest systemem AI. 5.1. The User's counterpart is an artificial intelligence system, not a human — this applies to both the text interview and the voice conversation. The voice agent introduces itself as an AI recruiter and, if asked, confirms that it is an AI system.

5.2. Rozmowa głosowa oraz funkcja dyktowania wymagają dostępu do mikrofonu. Audio jest przesyłane i przetwarzane przez zewnętrznych dostawców w celu rozpoznania mowy, syntezy głosu i prowadzenia rozmowy. Zasady przetwarzania — w tym informację o tym, że nagrania i transkrypty rozmów głosowych są przechowywane u dostawcy — opisuje Polityka prywatnościPrivacy Policy. 5.2. Voice conversations and the dictation feature require microphone access. Audio is transmitted to and processed by third-party providers for speech recognition, speech synthesis and running the conversation. The processing rules — including the fact that voice recordings and transcripts are stored by the provider — are described in the Privacy Policy.

5.3. Użytkownik odpowiada za to, by nie nagrywać ani nie przekazywać w rozmowie wypowiedzi osób trzecich bez ich wiedzy i zgody. 5.3. The User is responsible for not recording or transmitting statements of third parties during a conversation without their knowledge and consent.

5.4. Modele AI mogą sformułować treść nieprecyzyjnie, pominąć istotny fakt albo błędnie zinterpretować wypowiedź. Serwis nie podejmuje wobec Użytkownika zautomatyzowanych decyzji wywołujących skutki prawne — generuje dokument, nie ocenia Użytkownika. 5.4. AI models may phrase content imprecisely, omit a relevant fact or misinterpret a statement. The Service makes no automated decisions producing legal effects concerning the User — it generates a document, it does not evaluate the User.

6. Twoja odpowiedzialność za CV6. Your responsibility for the CV

6.1. Użytkownik podaje informacje zgodne z prawdą. Operator nie weryfikuje prawdziwości oświadczeń Użytkownika o jego doświadczeniu, wykształceniu ani kwalifikacjach. 6.1. The User provides truthful information. The Operator does not verify the accuracy of the User's statements about their experience, education or qualifications.

6.2. Konsekwencje przekazania pracodawcy dokumentu zawierającego dane nieprawdziwe, nieaktualne lub wprowadzające w błąd obciążają wyłącznie Użytkownika. 6.2. The consequences of submitting to an employer a document containing untrue, outdated or misleading data rest solely with the User.

6.3. Operator nie odpowiada za decyzje rekrutacyjne pracodawców ani za sposób, w jaki oceniają oni dokumenty przygotowane przy pomocy Serwisu. 6.3. The Operator is not responsible for employers' recruitment decisions or for how they assess documents prepared with the help of the Service.

7. Twoje treści7. Your content

7.1. Treści przekazane przez Użytkownika — wgrane pliki CV, wypowiedzi w rozmowie, notatki, wpisy bazy wiedzy — pozostają jego własnością. Operator nie nabywa do nich praw ponad zakres opisany poniżej. 7.1. Content provided by the User — uploaded CV files, statements made in conversation, notes, knowledge base entries — remains the User's own. The Operator acquires no rights to it beyond the scope described below.

7.2. Użytkownik udziela Operatorowi niewyłącznej, nieodpłatnej licencji ograniczonej do świadczenia usługi — czyli do przechowywania, przetwarzania i przekazywania tych treści dostawcom wskazanym w Polityce prywatności w celu przeprowadzenia wywiadu i wygenerowania CV dla Użytkownika. Licencja wygasa z chwilą usunięcia danych lub konta. Operator nie wykorzystuje treści Użytkownika do trenowania własnych modeli ani do celów marketingowych. 7.2. The User grants the Operator a non-exclusive, royalty-free licence limited to providing the service — that is, to store, process and transmit this content to the providers listed in the Privacy Policy in order to run the interview and generate a CV for the User. The licence expires when the data or the account is deleted. The Operator does not use User content to train its own models or for marketing purposes.

7.3. Użytkownik wgrywa wyłącznie własne dokumenty. Zabronione jest wgrywanie CV i danych osób trzecich bez podstawy prawnej, a także treści bezprawnych, obraźliwych lub naruszających cudze prawa. 7.3. The User uploads only their own documents. Uploading third parties' CVs or personal data without a legal basis is prohibited, as is uploading unlawful, offensive or infringing content.

7.4. Prosimy nie umieszczać w Serwisie danych szczególnych kategorii (np. o zdrowiu, wyznaniu, poglądach, przynależności związkowej) — nie są potrzebne do przygotowania CV. Zasady na wypadek ich podania opisuje Polityka prywatności. 7.4. Please do not enter special categories of data (e.g. health, religion, political views, trade union membership) into the Service — they are not needed to prepare a CV. The Privacy Policy explains what happens if you do.

7.5. Jeżeli dodajesz do CV zdjęcie, oświadczasz, że masz do niego prawa — że przedstawia Ciebie albo że dysponujesz zgodą na jego wykorzystanie. Odpowiadasz za to samodzielnie. 7.5. If you add a photo to your CV, you confirm that you hold the rights to it — that it shows you, or that you have permission to use it. This is your own responsibility.

7.6. Treść, którą wklejasz do sekcji własnych CV, trafia do dokumentu dosłownie — to Twoje własne słowa, więc nie przechodzi przez mechanizm pilnujący zgodności z bazą wiedzy. Odpowiadasz za jej prawdziwość i legalność tak samo jak za pozostałe informacje, które podajesz. 7.6. Content you paste into custom CV sections goes into the document verbatim — these are your own words, so it does not pass through the mechanism that checks consistency with your knowledge base. You are responsible for its accuracy and lawfulness just as for any other information you provide.

7.7. Aplikacja udostępnia wzór klauzuli zgody na przetwarzanie danych oraz pole na własną treść. Wzór ma charakter szablonu i nie jest poradą prawną — decyzja o umieszczeniu klauzuli w CV oraz jej ostateczne brzmienie należą do Ciebie. W aplikacji znajdziesz adnotację, że zgodnie ze stanowiskiem Prezesa UODO klauzula przy bieżącej rekrutacji zwykle nie jest potrzebna. 7.7. The application provides a template consent clause for data processing and a field for your own wording. The template is exactly that — a template, and not legal advice. The decision to include a clause in your CV and its final wording are yours. The application notes that, according to the Polish data protection authority (UODO), such a clause is usually unnecessary for a current recruitment process.

8. Ogłoszenia o pracę8. Job advertisements

8.1. Serwis pobiera treść ogłoszenia wskazanego przez Użytkownika (link lub wklejony tekst) — wyłącznie publicznie dostępną i wyłącznie w celu przygotowania aplikacji tego Użytkownika na to stanowisko. 8.1. The Service retrieves the content of the advertisement indicated by the User (a link or pasted text) — publicly available content only, and solely to prepare that User's application for that position.

8.2. Użytkownik odpowiada za legalność źródła wskazanego ogłoszenia, w tym za zgodność z regulaminem portalu, z którego pochodzi. Serwis nie służy do masowego pobierania ogłoszeń ani budowania ich baz. 8.2. The User is responsible for the lawfulness of the source of the advertisement, including compliance with the terms of the portal it comes from. The Service is not intended for bulk retrieval of advertisements or building databases of them.

8.3. Treść ogłoszeń pochodzi od podmiotów trzecich — Operator nie odpowiada za jej prawdziwość, aktualność ani za działania ogłoszeniodawców. 8.3. Advertisement content comes from third parties — the Operator is not responsible for its accuracy or currency, nor for the conduct of advertisers.

9. Czego nie wolno9. What is not allowed

Korzystając z Serwisu, Użytkownik nie może:When using the Service, the User must not:

• obchodzić limitów zużycia, zakładać wielu kont ani korzystać z konta innej osoby,circumvent usage allowances, create multiple accounts or use another person's account,
• podejmować prób obejścia zabezpieczeń, testowania podatności ani zakłócania działania Serwisu (w tym nadmiernego, automatycznego obciążania),attempt to bypass security measures, probe for vulnerabilities or disrupt the Service (including excessive or automated load),
• zbierać danych z Serwisu w sposób automatyczny (scraping), zwielokrotniać go ani udostępniać dalej jako własnej usługi,scrape data from the Service, reproduce it or offer it onward as your own service,
• używać Serwisu do tworzenia dokumentów dla innych osób, w celach komercyjnych ani do generowania treści niezgodnych z prawem,use the Service to create documents for other people, for commercial purposes, or to generate unlawful content,
• wykorzystywać Serwisu w sposób sprzeczny z prawem, dobrymi obyczajami lub jego przeznaczeniem.use the Service in a manner contrary to law, good practice or its intended purpose.

W razie istotnego lub powtarzającego się naruszenia Operator może ograniczyć albo zablokować dostęp do konta. O blokadzie informujemy e-mailem wraz z powodem; Użytkownik może odnieść się do niej w trybie reklamacyjnym (pkt 14). In the event of a material or repeated breach, the Operator may restrict or block access to the account. We notify you of a block by email together with the reason; the User may respond to it through the complaints procedure (section 14).

10. Własność intelektualna10. Intellectual property

10.1. Serwis — oprogramowanie, interfejs, teksty, grafiki, znak „certain.cv" — stanowi własność Operatora i podlega ochronie prawnej. Korzystanie z Serwisu nie przenosi na Użytkownika żadnych praw do tych elementów. 10.1. The Service — software, interface, texts, graphics and the "certain.cv" mark — is the property of the Operator and is legally protected. Using the Service transfers no rights to these elements to the User.

10.2. Wygenerowane CV Użytkownik może wykorzystywać dowolnie — w szczególności wysyłać pracodawcom, drukować, edytować i przechowywać, bez ograniczeń czasowych i bez konieczności oznaczania Serwisu jako źródła. 10.2. The User may use the generated CV freely — in particular to send it to employers, print, edit and store it, with no time limits and no obligation to credit the Service.

11. Dane osobowe11. Personal data

Zasady przetwarzania danych osobowych — w tym pełny wykaz zbieranych danych, dostawców AI, obsługi rozmów głosowych, okresów przechowywania i praw Użytkownika — opisuje Polityka prywatności, stanowiąca integralne uzupełnienie Regulaminu. The rules for processing personal data — including the full list of data collected, AI providers, voice conversation handling, retention periods and User rights — are set out in the Privacy Policy, which forms an integral supplement to these Terms.

12. Odpowiedzialność12. Liability

12.1. Operator dokłada starań, aby Serwis działał poprawnie, jednak — z uwagi na charakter bezpłatnej wersji beta — nie gwarantuje jego nieprzerwanej dostępności, bezbłędności ani przydatności do konkretnego celu. 12.1. The Operator makes efforts to keep the Service working correctly but — given the nature of a free beta — does not guarantee uninterrupted availability, freedom from errors or fitness for a particular purpose.

12.2. Operator nie ponosi odpowiedzialności za: skutki wykorzystania dokumentów bez ich uprzedniej weryfikacji przez Użytkownika (pkt 6), wyniki procesów rekrutacyjnych, działania pracodawców i portali z ogłoszeniami, awarie po stronie dostawców zewnętrznych oraz utratę danych wynikającą z działań Użytkownika (np. samodzielnego skasowania sesji lub konta). 12.2. The Operator is not liable for: the consequences of using documents without the User first verifying them (section 6), recruitment outcomes, the conduct of employers and job portals, outages on the side of third-party providers, and data loss resulting from the User's own actions (e.g. deleting a session or account themselves).

12.3. Powyższe ograniczenia stosuje się w zakresie dopuszczalnym przez prawo. Nie wyłączamy ani nie ograniczamy odpowiedzialności za szkodę wyrządzoną umyślnie, za szkody na osobie ani odpowiedzialności, której zgodnie z bezwzględnie obowiązującymi przepisami — w tym przepisami o ochronie konsumentów — wyłączyć nie można. 12.3. The above limitations apply to the extent permitted by law. We do not exclude or limit liability for intentionally caused damage, for personal injury, or any liability that cannot be excluded under mandatory law, including consumer protection law.

12.4. Zalecamy zachowanie własnej kopii istotnych dokumentów (np. gotowego CV) poza Serwisem. 12.4. We recommend keeping your own copy of important documents (e.g. a finished CV) outside the Service.

13. Rezygnacja i zakończenie13. Termination

13.1. Użytkownik może zrezygnować z korzystania z Serwisu w każdej chwili i bez podania przyczyny — wystarczy przestać z niego korzystać albo poprosić o usunięcie konta, pisząc na privacy@certain.cv. Usunięcie konta oznacza usunięcie danych zgodnie z Polityką prywatności. 13.1. The User may stop using the Service at any time and without giving a reason — simply stop using it or request account deletion by writing to privacy@certain.cv. Deleting the account means deleting data as described in the Privacy Policy.

13.2. Użytkownik może też samodzielnie, w aplikacji, kasować pojedyncze sesje rekrutacyjne oraz wpisy w bazie wiedzy. 13.2. The User can also delete individual recruitment sessions and knowledge base entries themselves within the application.

13.3. Umowa o korzystanie z Serwisu jest zawierana na czas nieokreślony i jest nieodpłatna. Konsumentowi przysługuje prawo odstąpienia od umowy zawartej na odległość w terminie 14 dni bez podania przyczyny — w praktyce realizuje je rezygnacja opisana w pkt 13.1; ponieważ usługa jest bezpłatna, odstąpienie nie wiąże się z żadnymi rozliczeniami. 13.3. The agreement to use the Service is concluded for an indefinite period and is free of charge. A consumer has the right to withdraw from a distance contract within 14 days without giving a reason — in practice this is exercised by the termination described in section 13.1; as the service is free, withdrawal involves no settlements.

13.4. Operator może zakończyć betę lub zamknąć konto z zachowaniem rozsądnego uprzedzenia wysłanego e-mailem, tak aby Użytkownik zdążył pobrać swoje dokumenty. Bez uprzedzenia dostęp może zostać zablokowany wyłącznie w przypadku naruszenia pkt 9 lub z przyczyn bezpieczeństwa. 13.4. The Operator may end the beta or close an account giving reasonable prior notice by email, so that the User has time to download their documents. Access may be blocked without notice only in the event of a breach of section 9 or for security reasons.

14. Reklamacje14. Complaints

14.1. Reklamacje dotyczące działania Serwisu można składać na adres privacy@certain.cv. Prosimy o opis problemu, datę jego wystąpienia i adres e-mail przypisany do konta. 14.1. Complaints about the Service can be submitted to privacy@certain.cv. Please describe the problem, the date it occurred and the email address linked to your account.

14.2. Odpowiadamy w terminie do 14 dni od otrzymania reklamacji, na adres e-mail, z którego została wysłana. 14.2. We respond within 14 days of receiving the complaint, to the email address it was sent from.

14.3. Konsument może skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, w tym z platformy internetowego rozstrzygania sporów (ODR) dostępnej pod adresem ec.europa.eu/consumers/odr. Skorzystanie z nich jest dobrowolne. 14.3. Consumers may use out-of-court complaint and redress mechanisms, including the EU online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr. Using them is voluntary.

15. Zmiany regulaminu15. Changes to these Terms

15.1. Operator może zmienić Regulamin z ważnych przyczyn — w szczególności zmiany zakresu lub sposobu działania Serwisu, zakończenia bety, wprowadzenia odpłatności, zmiany dostawców albo zmiany przepisów. 15.1. The Operator may change these Terms for valid reasons — in particular a change in the scope or operation of the Service, the end of the beta, the introduction of fees, a change of providers, or a change in the law.

15.2. O zmianie informujemy co najmniej 14 dni przed jej wejściem w życie — e-mailem na adres przypisany do konta lub komunikatem w aplikacji.
